ZaapIn Advisors Directory Terms of Use

These Terms of Use ("Directory Terms") govern your access to and use of the ZaapIn Advisors Directory ("Directory"). By accessing or using the Directory, you agree to be bound by these Directory Terms and our Main Terms of Service, which are incorporated herein by reference.

1. Nature of the Directory

• 1.1. Information Platform: The Directory is a technology platform provided by ZaapIn to facilitate the discovery of independent insurance advisors, brokers, and agencies ("Advisors"). We act merely as a digital conduit for information provided by third parties.
• 1.2. Not an Insurance Provider: ZaapIn is a software provider. We do not solicit, sell, or underwrite insurance policies.
• 1.3. Meaning of Badges: Terms like "Verified," "Partner," or "Premier" on this Directory refer solely to the Advisor's active subscription status and technical usage of the ZaapIn software platform. They do not constitute a regulatory endorsement, guarantee of licensure, or quality assurance of insurance advice.
• 1.4. Search Ranking: The order in which Advisors appear in search results may be influenced by factors such as profile completeness, responsiveness, subscription tier ("Premier" status), and user location. A higher ranking does not imply higher quality of advice.

2. Disclaimer of Liability

To the maximum extent permitted by law:

• 2.1. No Guarantee of Service: ZaapIn does not guarantee the accuracy, quality, suitability, or regulatory compliance of any Advisor listed. Users are solely responsible for verifying the credentials and license status of any Advisor they choose to contact.
• 2.2. Advisor Conduct: ZaapIn is not a party to any agreement, transaction, or interaction between you (the User) and an Advisor. We are not liable for any advice given, policies sold, or claims handled (or mishandled) by an Advisor.
• 2.3. Data Accuracy: Advisor profiles (including bios, contact info, licensing status, and affiliations) are self-reported. ZaapIn disclaims all liability for errors, omissions, or misrepresentations in this data.
• 2.4. Third-Party Links: Profiles may contain links to third-party websites (e.g., Advisor's personal website, LinkedIn). ZaapIn is not responsible for the content, security, or privacy practices of these external sites. Accessing them is at your own risk.

3. User Conduct

• 3.1. Permitted Use: You may use the Directory solely for personal, non-commercial purposes to find and contact insurance professionals for your own insurance needs.
• 3.2. Prohibited Use: You agree not to use the Directory for marketing, recruiting, scraping, data mining, or soliciting Advisors for non-insurance purposes.

4. Advisor Responsibilities (For Listed Profiles)

• 4.1. Accuracy: By maintaining a public profile on ZaapIn Advisors, you represent that all information provided is current and accurate.
• 4.2. Compliance: You represent that you hold all necessary valid licenses (e.g., from IRDAI) to solicit insurance business in the jurisdictions listed on your profile, where applicable to your role. Non-licensed staff utilizing the platform must not engage in solicitation activities prohibited by law.
• 4.3. Indemnification: You agree to indemnify ZaapIn against any claims arising from your interactions with users found through the Directory or misrepresentations in your profile.
• 4.4. Profile Content Responsibility: You acknowledge that you are the sole author and owner of your profile content. You grant ZaapIn a license to display this content but retain full liability for its legality.

5. Privacy & Data

• 5.1. Global Data Processing & Transfer (Consent): By creating a Partner Profile, you explicitly consent to your public profile information being processed, stored, indexed, and transferred globally (including to servers located outside your country of residence, such as in the USA or EU) to ensure maximum search visibility.
• 5.2. Lead Data: User inquiries are transmitted directly to the respective Advisor. ZaapIn processes this data solely to facilitate the connection.
• 5.3. Third-Party Tools & Analytics: The Directory integrates with third-party services (e.g., Calendly for scheduling, Google Analytics for traffic analysis, Algolia for search). By using these features, you acknowledge that your data (such as IP address, booking details, or search queries) may be processed by these providers in accordance with their respective Privacy Policies and Terms of Service.

6. Disputes

ZaapIn is under no obligation to become involved in disputes between Users and Advisors. If you have a dispute with an Advisor, you release ZaapIn from claims, demands, and damages of every kind arising out of such disputes.

7. Intellectual Property

The compilation, arrangement, and assembly of data in this Directory are the exclusive property of ZaapIn. You may not copy, reproduce, or create derivative works from the Directory content without express written permission.

8. Disclaimer of Warranties

The Directory is provided on an "as is" and "as available" basis. ZaapIn makes no warranties that the Directory will be uninterrupted, timely, secure, or error-free. We do not guarantee that any specific Advisor will respond to inquiries.

9. Termination & Removal, Loyalty & Rewards

9.1. Right to Delist: ZaapIn reserves the right to remove or hide any Advisor profile at any time, for any reason, including inactive software subscription or user complaints.

9.2. Forfeiture upon Termination: In the event of termination for cause (e.g., fraud, misrepresentation), any accrued benefits or directory status may be forfeited immediately.

9.3. Badge Discretion: ZaapIn reserves the right to modify the criteria for Networker Badges, introduce new tiers, or revoke badges from users who violate community guidelines or engage in gaming the system. Badges are a recognition of platform activity and do not constitute a contractual entitlement or monetary asset.

10. Governing Law

These Directory Terms shall be governed by the laws of India. Any disputes shall be resolved in accordance with the dispute resolution process outlined in our Main Terms of Service.

11. Changes to Terms

ZaapIn reserves the right to modify these Directory Terms at any time. Continued use of the Directory after any such changes constitutes your acceptance of the new Terms.
